Re: Supreme Court Updates: Justices Further Weaken Voting Rights Act, Igniting Political Scramble by The New York Times

My FaceBook Post

ANOTHER DEFEAT FOR RACISM!!!

Don’t believe the NYT wording. Section 2 of the Voting Rights Act of 1965 “prohibits voting practices or procedures that discriminate on the basis of race, color, or membership in one of the language minority groups.” This ruling doesn’t “weaken” or “gut” the Voting Rights Act.

It is consistent with it, and a resounding affirmation of the 14th Amendment. Note that the 3 Liberal justices dissented, saying that the ruling would “systematically dilute minority citizens’ voting power.” In fact, all of the hysteria by Leftists focuses on some similar collectivist tribal argument, as if certain “minority” GROUPS have a privileged entitlement to elect a representative with a particular skin color or ethnicity. It’s a viewpoint straight out of the Dred Scott decision that informed the Confederacy’s defense of its slave system.

But this racist viewpoint is anti-Enlightenment and anti-American. America guarantees an INDIVIDUAL right to vote, not some primitive tribal “right” or “voting power.” The 14th Amendment guarantees EACH CITIZEN equal protection. This ruling affirms the “one-person-one-vote” principle, and nobody’s right to vote is compromised or restricted—in fact, only strengthened. So-called “voting power” rests with individuals, not groups.

The violent Leftist reaction to the ruling also affirms the fundamental racial/collectivist orientation of the Left and the Democratic Party (I deliberately chose the NYT article to demonstrate this). That political block sees every issue through a lens of race. But, MEMO to the Left: dark skinned people are INDIVIDUALS, each with a mind of their own, capable of deciding FOR THEMSELVES how to vote, just like every other person. They are not some homogenous colored herd with some collective brain that they must be told they must follow.

Don’t believe the way most of the press is characterizing this ruling. This decision is a great outcome.

DEI Exposed for What it Means, and Where it Leads

New Jersey Spotlight News )NJSN) has a very revealing piece on President Trump’s war on the Left’s Diversity, Equity, and Inclusion (DEI) movement—Taylor Jung’s ‘Chilling effect’ feared as Trump administration attacks DEI. Here is an annotated review of Jung’s “news” article. Indented portions are direct quotes from the article, with my emphasises.

Escalating federal pressure to end diversity, equity and inclusion (DEI) initiatives is raising more questions than answers about the future of anti-discrimination programming in New Jersey and across the nation.

I have observed that NJSN leans strongly Left in its reporting. So right off the bat, incredibly disingenuous! DEI requires discrimination. Only the tribalism of relying on statistical "disparities" rather than actual evidence can justify seeing DEI programs as an anti-discrimination tool.

Last week, the Department of Justice signaled it could criminally investigate companies engaged in what it called “illegal” race- and sex-based discrimination under the “guise” of DEI.

Note the framing. DEI requires race- and sex-based discrimination to achieve its self-described “equitable” ends, which means eliminating statistical disparities. Yet, Jung prefaces its reporting with a “what it called ‘illegal’” preface, and followed it up by referring to DEI as a “guise”—to what end . . . to protect racism? Apparently:

Legal and workforce experts say it could have a “chilling” effect on programs meant to combat prejudice

How do you combat prejudice through race- and sex-based discrimination?

and to promote equitable working environments

"Equitable" means fair and impartial. How does discrimination lead to that? Of course, to the Progressive/Woke Left, equitable means Egalitarianism, the enemy of fairness and merit.

It is also not clear what criminal laws the Trump administration is citing, those experts say.

“I think that, yes, that is an effort to utilize the kind of mechanism of civil rights law, not in favor of the groups that have been historically served by those laws because they were the impetus for those laws, but instead to say, ‘We believe society has gone too far in the direction of protecting the interest of those groups,’” said Stacy Hawkins, a professor at Rutgers Law School.

Note what's missing from this diatribe—the individual. And the individual is who gets discriminated against—i.e., marginalized, if the Left's favorite term has any meaning—when "protecting the interest of those groups." Groups are made up of individuals. Those who erase the individual from any moral, social or political consideration are not defenders of any group, and the Civil Rights Laws do not and were never meant to protect groups, only individuals. The law should never favor or disfavor any group. It should universally secure and protect individual rights and equal protection of the law.

In order to systematize sex and race based discrimination, the DEI crowd is totally misrepresenting the Civil Rights Laws. Certainly, the historical  discrimination against black Americans were “the impetus for those laws." But the Civil Rights laws were never a mechanism for reverse discrimination. They insert universal principles meant to protect all groups from the kind of discriminatory injustices that victimized the black group, through the mechanism—the principles—of individual rights.

Workers are protected under Title VII of the Civil Rights Act of 1964, which prohibits workplace discrimination based on gender, race, color, religion and nationality. But Title VII is a civil law, not a criminal one.

This may be true. But whether civil or criminal, DEI requires precisely what Title VII prohibits—workplace discrimination based on gender, race, color, religion and nationality (Whether this provision should apply to private enterprise is another discussion).

This should be obvious to any objective person. I can’t believe Jung can’t see the blazing contradiction in his reporting. So, why DEI?

“It is unconscionable that the Trump administration would coopt the language and vision of the civil rights movement in these executive orders as it attempts to send our nation back to an era of rampant, state-sanctioned discrimination [!!!]

Which is exactly what DEI does. Biden's "whole of government approach" to systemitizing DEI is new era of rampant, state-sanctioned discrimination. This is exactly what Trump's policy is designed to save us from, as is obvious to anyone with any inkling of understanding capacity. By now, the absurdity and evasiveness of this article can not be hidden. Read on:

Ultimately, these measures drive us farther away from a future when health is no longer a privilege, but a right for all,” said Dr. Richard Besser, president and CEO of the Robert Wood Johnson Foundation. (The Robert Wood Johnson Foundation is a funder of NJ Spotlight News.)

There you have it. The ultimate goal of collectivist DEI. Totalitarian Socialism. Who would enforce this "right" to health? Slaves, that's who. If someone needs health care as a right, then those with the capability to provide it—the doctors and other health professionals—cannot refuse to provide it. Those who pay for it cannot refuse. The same goes for any economic "right"—a "right" to housing, education, food. Socialism is slavery, and totalitarian Socialism is the ultimate goal of anyone who preaches Diversity, Equity, and Inclusion. After all, Socialism requires collectivism, and what better way to condition people to accept collectivism than by systematizing the easiest form of collectivism—racism.

NJ Should Pass on the International Holocaust Remembrance Alliance’s Definition of Anti-Semitism

New Jersey Spotlight News reports that there is Strong support in Assembly for adopting IHRA definition of antisemitism, but adds that “Aspects of the International Holocaust Remembrance Alliance’s definition are controversial.” Indeed. NJSN reports:

The International Holocaust Remembrance Alliance’s definition underlines widely accepted aspects of antisemitism, including statements that the Holocaust was a lie or exaggerated, or claiming that Jewish people control the media. What has proved controversial is the part of the definition that specifies certain criticisms of Israel — that Israel is a racist state, and that Israelis should be held to a different standard than other democracies — as antisemitic.

“This has nothing to do with Jews. This is about protecting Israel,” said Raz Segal, an associate professor of Holocaust and Genocide Studies at Stockton University. “It silences Palestinians who, for example, will say that Israel is a racist state, which is a very legitimate critique against any other state in the world, including the United States.”

The International Holocaust Remembrance Alliance’s definition includes this example:

"Denying the Jewish people their right to self-determination, e.g., by claiming that the existence of a State of Israel is a racist endeavor."

Of course, identifying "the Jewish People" as a collective is racist, by definition. A group of Jews has no right to a state that legally prioritizes Jews over non-Jews. A legitimate state recognizes individual rights equally for all. If the above IHRA example is taken literally, then the state of Israel is a racist endeavor. All individuals have a right to their own personal self-determination, whether acting individually or in voluntary agreement with others as a group. But none should be favored or disfavored under the law.

So, is the State of Israel designed to guarantee only the Jewish people their collective right to self-determination?] If so, Israel is racist. But Israel's Declaration of Independence states:

THE STATE OF ISRAEL will be the Jewish people their right to self-determination and for the Ingathering of the Exiles; it will foster the development of the country for the benefit of all its inhabitants; it will be based on freedom, justice and peace as envisaged by the prophets of Israel; it will ensure complete equality of social and political rights to all its inhabitants irrespective of religion, race or sex; it will guarantee freedom of religion, conscience, language, education and culture; it will safeguard the Holy Places of all religions; and it will be faithful to the principles of the Charter of the United Nations.

Despite the opening nod to  "the Jewish people [and] their right to self-determination," that paragraph doesn't sound racist to me. In fact, Israel, while majority Jewish, includes 20% Palestinian, ranging from Arab descent to Christian orientation, as well as Muslim. There are atheists and the non-Jews also, all of whom live in equality under the law. But the point is that accusing Israel of being a racist state, or of having racist policies or laws, does not necessarily make that person anti-Semitic. The IHRA definition of antisemitism seems to shield racists who happen to be Jewish from criticism. But a racist who happens to be Jewish is still racist, and people should be free to call that person out without being accused of being an anti-Semite.

The IHRA definition of antisemitism includes some uncontroversial manifestations. For example:

Accusing Jews as a people of being responsible for real or imagined wrongdoing committed by a single Jewish person or group, or even for acts committed by non-Jews.

Yes, this is anti-Semitic. But such views are racist across the board. Substitute “Jews” with black and “Jewish” with black (or any other ethnic group), and you still get racism. Racism is the idea that a person's beliefs, character, choices, and moral standing are inherited through body chemistry—such as skin color, genes, or blood—and thus should be judged by the actions of ancestors of his ethnic group. That definition already describes anti-Semitism. It doesn’t need a special exception.

The IHRA’s definition of antisemitism is a bad, biased definition. It seems more designed to shield Jews from criticism than to present an objective definition of anti-Semitism.

I should clarify that NJ’s adoption of the IHRA’s definition of antisemitism would not have legal teeth, as there are no hate speech laws in the state, which would be anti-free speech and unConstitutional under the First Amendment. NJSN reports:

A bill that would have New Jersey adopt the International Holocaust Remembrance Alliance’s definition of antisemitism has overwhelming support in the state Assembly, with three primary sponsors and 56 co-sponsors out of 80 possible representatives.

Supporters say a clear definition of antisemitism would protect Jewish people and make hate speech easier to spot and stamp out.

But it is clearly a step toward censorship, especially given the prevalence of DEI initiatives in NJ. The government should never be in the business of “stamping out” any speech, either explicitly through laws or implicitly through biased legal language.

Kamala re-Affirms Democrats’ Long-Held Racist, White Supremacist Ideological Core

Harris announces a new plan to empower Black men as she tries to energize them to vote for her, reported the Associated Press. Her scheme includes  [Youtube]

Vice President Kamala Harris announced a plan on Monday to give Black men more economic opportunities and other chances to thrive as she works to energize a key voting bloc that has Democrats concerned about a lack of enthusiasm.

Harris’ plan includes providing forgivable business loans for Black entrepreneurs, creating more apprenticeships and studying sickle cell and other diseases that disproportionately affect African American men.

Harris already has said she supports legalizing marijuana and her plan calls for working to ensure that Black men have opportunities to participate as a “national cannabis industry takes shape.” She also is calling for better regulating cryptocurrency to protect Black men and others who invest in digital assets.

Harris’s Opportunity Agenda for Black Men, according to her campaign website, is to "provide black men with the tools to achieve financial freedom, lower costs to better provide for themselves and their families, and protect their rights. This pathbreaking agenda includes:

(1) Providing 1 million loans that are fully forgivable to Black entrepreneurs and others to start a business.

(2) Championing education, training, and mentorship programs that help Black men get good-paying jobs in high-demand industries and lead their communities, including pathways to become teachers.

(3) Supporting a regulatory framework for cryptocurrency and other digital assets so Black men who invest in and own these assets are protected.

(4) Launching a National Health Equity Initiative focused on Black Men that addresses sickle cell disease, diabetes, mental health, prostate cancer, and other health challenges that disproportionately impact them.

(5) Legalizing recreational marijuana and creating opportunities for Black Americans to succeed in this new industry.

Her so-called  “opportunity agenda for Black men” has rightly been tagged as a desperate vote-buying scheme. But there is a deeper meaning here.

A desperate Kamala Harris, following Biden, re-affirms the Democratic Party's 196 year-old racist, white supremacist orientation. The U.S. Supreme Court’s 1857 Dred Scott decision  declared that “African Americans were 'beings of an inferior order.”

The Democratic Party, in its 1856 and 1860 Party Platforms, fully endorsed Dred Scott and its assertion of blacks as “beings of an inferior order.” Then, the prevailing pro-slavery position—of which the Democratic Party officially embraced—held that Africans were like children who needed to be taken care of by plantation masters. The Party hasn’t changed its ideological stripes. Blacks still need that special help to succeed; only today, the state replaces the plantation master as the parent in the role of taking care of African-Americans. Harris’s plan, which follows on the heels of Biden’s racist schemes for black farmers and restaurateurs, makes this clear.

There is no room for equivocation here. It’s plain as day. How else to explain Harris’s regressive, explicitly racist anti-14th Amendment, anti-1964 Civil Rights Act policy. The Democratic Party continues to be, as it has been since its founding in 1828, the party of racism and white supremacy. Its policies and rationalizations have changed, but its fundamental values have not.

[Supplemental: The Harris campaign apparently went swiftly into damage control. The Wall Street Journal reports that “Vice President Kamala Harris’s ‘Opportunity Agenda for Black Men’ . . . will be open to all Americans on a race-neutral basis.” Apparently, her loud, obvious rhetoric doesn’t mean what she says, based on two words, “and others.”  See point (1) above. Give me a break! This vague reference to race neutrality is likely inserted as a way of possibly getting around a Supreme Court, and the American public at large, that has largely lost its tolerance for racist policies, like Affirmative Action. But the intent is clear.]

The Hideous Perversion of Capitalizing ‘Black’

There is a concerted effort by thought leaders, mainly of the Left orientation, to internalize racism in the minds of Americans. By “internalize,” I refer to the subconscious. The subconscious is an integrating and automatizing mechanism. When an idea or premise becomes embedded in the subconscious, the individual develops automatic responses to real life situations based on subconscious premises. These automatic responses help shape a person’s behavior, character, and judgements, often in ways the person doesn’t consciously realize. This goes for a person’s morals, too.

So what does this have to do with racism? Think how regularly the issue of race enters the discussion of cultural or political issues. The identity politics of the Left is the most obvious. But race permeates most of the media, as well. Race is embedded in issues that seemingly have nothing to do with skin shade, such as hunger and auto insurance rates. I provided a couple of examples here.

But there is a more insidious tactic than concrete issues emerging in recent years. That’s what this post will focus on. That tactic is to capitalize skin color as an immutable identifying factor of individuals. For example, black American becomes Black American, or white person becomes White person. I see no other purpose other than the insidious purpose of getting people to automatically include skin race as relevant in judging and identifying a person.

This amounts to a psycho-epistemological attack on individualism, and of reason. It is an attack on the philosophical heart of the Enlightenment and thus on Americanism. It supplants individualism with collectivism, and as Ayn Rand has observed, racism is “the lowest, most crudely primitive form of collectivism”—and, as Rand observed, “the simplest collective to join, . . . the easiest one to identify, the least demanding form of ‘belonging’ and of ‘togetherness’ is: race.” So if you want to destroy individualism, and elevate collectivism—as the modern Left wants to do—what better place to start is there but to elevate racism.

Many major news organizations have adopted the racist tactic of capitalizing skin color, some capitalizing “black” and some capitalizing “black” and “white” and even “brown,” in their writing style guides. Let’s check out a couple of articles defending this racist psychological invasion of our language. Italics will be my emphasis unless otherwise noted.

Kwame Anthony Appiah argues in The Atlantic, The Case for Capitalizing the B in Black, that

Black and white are both historically created racial identities—and whatever rule applies to one should apply to the other.

True. There is only one race of humans, universally identified by the characteristics of reason and free will—the “rational animal.” Rationality spans across all skin colors. So why not simply eliminate these arbitrary “historically created racial identities,” rather than institutionalize racism in our language, and identify every person as part of the human race? Of what value are racial identities other than for nefarious purposes?

Should the b in black, as a designation for people of African descent, be uppercase? Media outlets and other institutions are asking themselves that question these days, and many are answering in the affirmative. But the reasons given for why can sometimes be perplexing—in a way that reveals larger perplexities about the meaning of race.

Everyone knows that black people aren’t literally black. Plenty of white Americans are darker in complexion—look at your olive-skinned friends of Mediterranean or Armenian extraction—than plenty of black Americans. If Kim Kardashian, the media personality and entrepreneur, counts as white while Maulana Karenga, the radical activist and creator of Kwanzaa, counts as black, it isn’t because he’s darker than she is. So the color term is a poor metonym for the group in question.

But if we already have “African” to identify people of African descent, what purpose is served by substituting skin color for a continent?

And there’s plainly a rationale for capitalizing black in order to head off ambiguity (what am I referring to when I refer to “black hair”?). For many advocates of the uppercase, though, the stakes are far greater. “Black with a capital ‘B’ refers to a group of people whose ancestors were born in Africa, were brought to the United States against their will, spilled their blood, sweat and tears to build this nation into a world power and along the way managed to create glorious works of art, passionate music, scientific discoveries, a marvelous cuisine, and untold literary masterpieces,” Lori L. Tharps, who teaches journalism at Temple University, wrote in 2015. “When a copyeditor deletes the capital ‘B,’ they are in effect deleting the history and contributions of my people.” Or as Anne Price, the president of the Insight Center for Community Economic Development, put it last year: “capitalizing Black is about claiming power.”

So America is to be singled out for the horror of slavery, despite the fact that slavery had been a worldwide institution for thousands of years, and that America inherited this particular form of slavery, African slavery, from England. Plenty of people were forcibly relocated against their will. White Southern Europeans, especially Italians, were forcibly taken to North Africa as slaves. What person of even minimal self-esteem would want to be identified by ancestral slaves?

But it gets worse. The racists sneak in the hideous premise that African slavery, rather than Capitalist freedom, “built this nation”; which means, slavery is a positive good! Well, the Confederate slavocracy’s leading defender of plantation slavery, George Fitzhugh, made the same argument in his Sociology for the South: Or the Failure of Free Society. Why would anyone align with Fitzhugh and the slave-holding American South? Because both fitzhugh and modern racists share a common hatred, Capitalism, which is integral to American principles.

When W. E. B. Du Bois campaigned, back in the 1920s, for Negro, rather than negro, he remarked, mordantly: “Eight million Americans are entitled to a capital letter.” According to the diversity committee of USA Today, which decided last week to capitalize the B-word, the change reflected “understanding and respect.”

They already have one—American. Or, if one prefers, African-American. Once again, why substitute “Black” for African or American? Is there a more noble identity than American? Indeed, what person of even minimal self-esteem would want to be identified by his skin color?

So what about white folks? . . . The style guide of the American Psychological Association declares, as it has for a generation: “Racial and ethnic groups are designated by proper nouns and are capitalized. Therefore, use ‘Black’ and ‘White’ instead of ‘black’ and ‘white.’” That seems sensible enough. But for some people, White is the sticking point.

If you consider the capital letter to be a conferral of dignity, you may balk at the symmetry. “We strongly believe that leaving white in lowercase represents a righting of a long-standing wrong and a demand for dignity and racial equity,” Price, of the Insight Center, wrote. Until the wrongs against black people have been righted, she continued, “we cannot embrace equal treatment in our language.” The capital letter, in her view, amounts to cultural capital—a benefit that white people should be awarded only after white supremacy has been rolled back.

In other words, tribal revenge. Well, I can tell you, I find it revolting and demeaning to have my skin color elevated to an identifying factor. There is nothing dignified in capitalizing my skin color. And when will white supremacy be rolled back? And how? The answer is simple: when Capitalism and individualism have been abolished, and replaced with . . . what? Collectivism and its political manifestation, statism, most likely totalitarian socialism. That’s the real motive behind the whole movement to capitalize skin color, given that racism is the most obvious form of collectivism.

This line begs a crucial question. What, exactly, is the “long-standing wrong?” Racism, that’s what. Why, then, institutionalize racism in the language?  Apparently, unlike the Abolitionists of the 19th Century or the Civil Rights crusaders of the 20th Century, these 21st Century activists are out to save racism, rather than eradicate it.

Finally, in explaining Why ‘White’ should be capitalized, too, Nell Irvin Painter explains for the Washington Post:

[I]n terms of racial identity, white Americans have had the choice of being something vague, something unraced and separate from race. A capitalized “White” challenges that freedom, by unmasking “Whiteness” as an American racial identity as historically important as “Blackness” — which it certainly is.

No longer should white people be allowed the comfort of this racial invisibility; they should have to see themselves as raced. Being racialized makes white people squirm, so let’s racialize them with that capital W.

This is pure, hateful tribal revenge. It erases the individual, assuming that all white people deserve to “squirm.” It is also incredibly juvenile. How about embracing individualism so no one has to “see themselves as raced?” Your damn right it makes me squirm, but not in the way Painter means it. It is offensive and racist, and it angers me—as it should any person of integrity and self-esteem regardless of skin color. Skin color has nothing to do with character, which is self-made. Isn’t racial invisibility the goal we should promote? Not according to primitives like Nell Irvin Painter.

While Painter's goal is to promote racial identity, others claim that capitalizing black isn’t about race at all, but about culture. As NJ.com, parent of the New Jersey Star-Ledger and other NJ news outlets, explains:

We are making this change to NJ Advance Media’s style guide to acknowledge and respect the word represents a people with shared cultures and experiences, and not a color. Black, we believe, should be used like other identifiers, such as “Asian,” “Latino” or “African American.” We also will continue to use “African American” in stories when warranted, as “African American” and “Black” aren’t always interchangeable.

So, which is it? Culture of race?

I could go on and on, because every justification for capitalizing skin color that I’ve read is just more of the convoluted rationalizing nonsense. The rationalizations are endless, but can’t change the fact that capitalizing skin color promotes racism—is, in fact, racism. But I’ll stop here. I’ve made my point. None of this is to say that race as determined by skin color doesn’t matter anymore. Though America has experienced significant progress in racial relations in recent decades, and today there is less racism in America than ever, bigotry still exists. But shouldn’t racial bigotry be fought, rather than institutionalized? I certainly believe so.

So capitalizing a descriptive word like color to describe a person is a huge step backwards. It is part of the regression to tribalism. The rise of civilization is the rise of individualism, so the current rise in tribalism literally signals the invasion of savagery into civilization. Like a deadly virus, tribalism threatens to destroy it. Collectivism and individualism cannot coexist.

Many, if not most, major media outlets have fallen all over themselves to comply with this Woke outrage. These include the Associated Press, New York Times, Los Angeles Times, the New Jersey Star-Ledger (which capitalize black only), the Washington Post, The Atlantic, and Fox News  Media (which capitalize black, white, brown, etc.). Shame on them. If they really want to correct the long-standing wrong of racism, they should simply abandon racism in all of its hideous manifestations. This style change is consistent with Ibram X. Kendi’s primitive doctrine that “The only remedy to past discrimination is present discrimination. The only remedy to present discrimination is future discrimination,” and just as racist.

Stop capitalizing skin color. It is anti-Enlightenment, unjust, racist, and uncivilized.
